New Schengen Visa Rules for Indian Visitors: Key Questions Answered

Peden Doma Bhutia

Peden Doma Bhutia , Skift

April 23rd, 2024 at 5:39 AM EDT

Destinations value Indian travelers, but lengthy visa processing times lasting months act as significant deterrents. The adoption of these new regulations by European authorities reflects a proactive effort to tackle these concerns, aiming to boost tourism flow.

Peden Doma Bhutia

  • Which countries are included in the Schengen area?
  • How can Indian nationals qualify for the longer-term, multi-entry Schengen visas?
  • Are there any restrictions or conditions associated with the new Schengen visas?

Select a question above or ask something else

  • New Schengen visa rules for Indian nationals offer longer-term, multi-entry visas based on travel history.
  • Visas provide travel rights equivalent to visa-free nationals within the Schengen area but do not grant the right to work.
  • Change aims to standardize visa issuance and recognize the economic benefits of Indian tourists.

The European Commission has introduced new Schengen visa rules for Indian nationals, aiming to provide longer-term, multi-entry visas based on the applicant's travel history. This change comes in response to complaints from Indian travel agents about visa delays. The new regime allows for two-year and five-year visas, depending on the applicant's visa history and passport validity. These visas offer travel rights equivalent to visa-free nationals within the Schengen area, which comprises 29 European countries. However, the visas do not grant the right to work and are for short stays only. The change is expected to standardize visa issuance processes and acknowledge the economic benefits of Indian tourists to Europe.

The European Commission has introduced a new visa “cascade” regime for Indian nationals applying for Schengen visas in India. This regime looks to offer longer-term, multi-entry Schengen visas, based on the applicant’s travel history.

Indian travel agents had been complaining of Schengen visa delays as a major challenge to the summer travel rush from India.

  • How does one qualify for the longer duration visas?

The European Commission can issue a two-year multiple-entry visa after a traveler “has obtained and lawfully used two visas within the previous three years.” This demonstrates a positive travel history and compliance with previous visa regulations.

Subsequently, after granting the two-year visa, authorities may issue a five-year visa if the passport has has adequate validity remaining.

  • What benefits do holders of these extended visas enjoy?

During the validity period of these visas, holders can enjoy travel rights equivalent to visa-free nationals within the Schengen area, allowing for short stays of up to 90 days within a 180-day period.

  • Which countries are part of the Schengen area?

The Schengen area comprises 29 European countries, including 25 European Union member states: Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Germany, Estonia, Greece, Spain, France, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland, and Sweden. Additionally, Iceland, Liechtenstein, Norway, and Switzerland are also part of the Schengen area.

  • Are there any restrictions or conditions to these visas?

Schengen visas do not grant the right to work within the Schengen area and are for short stays only. Additionally, the visas are not purpose-bound, providing flexibility for travel within the specified period.

Industry Take

Skift also spoke to players in the Indian outbound travel industry to understand what has changed in the new Schengen visa rules.

  • How is this different from the earlier visas that Schengen countries offered? Don’t they already offer multi-entry visas with longer duration to Indians?

Mahendra Vakharia, managing director of Pathfinders Holidays, said there was no standard policy of Schengen states for issuing these long-term visas earlier. Switzerland, France, Netherlands, Italy and Spain usually issued long-term visa, but it was all subjective. “With this new policy it should be a standard rule now,” Vakharia said.

  • Travelers mainly complain of longer processing times, has that changed?

Here too, there is no standard processing time as it varies from country to country, according to Vakharia. “France and Spain have been processing visas within four days, and then there’s Croatia, which takes 60 days,” he said.

Processing time will not change as of now, it will take time for the visa rules to be enforced, said an industry source, while highlighting that the visa would be especially useful for corporate travelers.

What Promoted The Move?

Speaking on the possible motivations, Vakharia acknowledged various reasons, including administrative capacity constraints at embassies to cater to the huge inflow of applications.

“As there is an overwhelming demand from Indian travelers, the process of securing visa appointments has posed significant challenges , especially for travelers residing in cities lacking VFS Global centers,” he said.

The European Commission said in an statement that the decision reflects the EU-India Common Agenda on Migration and Mobility, aimed at fostering comprehensive cooperation on migration policy. Facilitating people-to-people contacts is a key aspect of this agenda, acknowledging India’s importance as an EU partner.

The decision also reflects a realization of the strong economic benefits derived through the spending power of Indian tourists. As Vakharia aptly puts it, “Why let go of the Golden Indian Goodie Bag?”

Malta, Sweden, Belgium and France are the top four Schengen Area countries most likely to reject a Schengen visa in 2022, as the four of them individually have the highest rejection rates in the whole bloc for the past year.

Newly released data by Schengen Visa Statistics show that Malta tops the table when it comes to the largest share of visa applications rejected, which is as high as 36.4 per cent for the consulates and visa centers of this country.

While the share of rejection rate is high for Malta, a number of negative decisions made is quite low compared to other countries, as the number of applications filed at the Maltese authorities abroad was low too.

The country rejected 7,915 applications out of 22,275 received, SchengenNews reports.

Second is listed Sweden, with 29 per cent of applications rejected, or 38,652 out of 135,946 applications. Belgium comes third with 28.4 applications rejected, or 46,569 out of 171,966, followed by France, which is the country with the highest number of negative decisions taken on Schengen visa applications filed in 2022.

The French authorities abroad turned down a total of 408,876 applications last year, which due to the almost two million applications this country received (1,918,515), its rejection rate is set at 22.2 per cent, or the fourth highest in the entire Schengen Area.

The overall rejection rate for the Schengen Area in 2022 was 17.9 per cent.

Taking into account solely the number of rejected applications and not the rate, the list would be as follows:

  • France – with 408,876 applications rejected
  • Spain – 227,712
  • Germany – 167,517
  • Italy – 92,186
  • Netherlands – 70,566

Last year, on the other hand, the rejection rate was quite lower, at only 13.4 per cent, and the countries contributing most to it were Sweden with a rejection rate of 30.6 per cent, Norway with 26.2 per cent, Denmark and France with 21.1 per cent each, and Belgium with 20.4 per cent.

  • Sweden, Norway, France & Denmark Were Most Likely to Reject Schengen Visas in 2021

According to SchengenVisaInfo.com , there are 11 most common reasons why the Schengen countries reject visa applications, with some of the main being insufficient proof of financial means for a trip, lack of travel insurance for Schengen Zone , or not having obtained the right one,  presenting an invalid passport, no flight/ticket itinerary or having a criminal past.

The third countries in the territory of which the Schengen countries rejected the highest number of visas are as follows:

  • Algeria – 48.2 per cent
  • Nigeria – 45.6 per cent
  • Sri Lanka – 44.2 per cent
  • Ghana – 44.2 per cent
  • Haiti – 43.2 per cent

In many of third countries, Spain, and in particular France, are the Schengen countries that rejected for the highest number of applications in 2022.

  • 30% of Schengen Visa Applicants in Morocco Were Rejected in 2022, Mostly by France & Spain

DISCLAIMER : Some of the numbers presented for the total of applications filed, granted and rejected, may not add up and exhibit moderate differences since the consulates calculate the number of applications received and processed from January 1 to December 31. This means consequently, the data for granted and rejected applications may include filings from the previous year. Furthermore, applications submitted towards the end of the year that cannot be processed within the same year will be carried forward to the subsequent year for processing.
