The Safari House sits in a tree canopy and overlooks a wet-weather creek and a valley of trees with nature in abundance. If you are looking for a unique experience or wanting to create a special getaway, the Safari House is the perfect venture. Inside find a modern day whimsical take on an African-theme reminiscent of the plains where giraffes, elephants, and zebras roam.The lovely wooden interior boasts a wooden decor, with surrounding windows allowing lots of natural light in. Experience these wonders with the comforts of modern day conveniences. With fun animal decor and comfortable linens everyone will sleep well on this adventure. Inside find a Queen size bed, and the upstairs loft hosts a full and trundle bed. Tidy up in the bathroom with a stand up shower, and roomy sink area. Relax, in the cozy living and dining areas, guests enjoy leather seating with accents of zebra print, a cozy dining area, a flat-screen television, and a kitchenette with all the amenities needed to cook up simple meals including a microwave, a toaster oven, a hot plate, as well all the necessary plates and utensils, other amenities include Wi-Fi. Outside, enjoy a charming porch at the front of the cottage, with deck chairs for guests to kick back with their favorite beverages and enjoy the fresh air. Unwind on the porch swing under the cottage for a unique spot to sit by the koi pond, waterfall and stream. Barbeque favorites on the outdoor grill. Take a walk along rock-lined paths and take in the dreams, creeks, and wildlife. Enjoy use of the umbrella picnic tables, a game of corn holes or s'mores around the fire pit in the communal outdoor space. Visit, Hamilton Pool Reserve for a day of swimming and picnicking, Dr. Pound Historic Farmstead learn about farming and the history of the area, Dripping Springs Ranch Park, or Pedernales Falls State Park are great for swimming or hiking, , with many wineries in the area enjoy wine tasting, for nature enthusiasts enjoy rock climbing at Reimers Ranch, or two-step and enjoy live music at the historic downtown Mercer Street Dance Hall. There is plenty to do in and around the area. *The health and safety of our guests is paramount. Cleanliness is always our top priority. For us (we’re obsessed), sleeping in a treehouse is an experience like no other. Imagine being alone deep in the wilderness, surrounded by nothing but the sounds of nature and the soft glow of lanterns. It’s like stepping into your own dreamy world, where anything is possible, and adventure is just a step away – or a few metres below. 

Perched high up in the branches offers a unique perspective on the world. You’re in the heart of nature, surrounded by creatures great and small, yet somehow, you feel completely at peace. Listening to the sounds of the wild, sipping on a chilled bottle of the Cape’s finest and watching the sunset. It’s a surreal experience, one that will leave you in awe of the world we live in.

And the best part? It’s fun. You get to reconnect with your inner child! Something about being up high in the trees brings us a sense of wonder and imagination. It’s like a magical escape from the real world, where you can let go of all your worries and just be.

They’re set up with everything you need for a cosy night’s sleep, including soft bedding and warm blankets. And a guide is stationed close by to ensure you’re safe and sound.

Ngala Treehouse

The Ngala Treehouse is a must-visit for anyone staying at the romantic Ngala Tented camp . This designer treehouse (our favourite) is located in the Greater Kruger National Park in South Africa. Still, it’s probably more extensive than most apartments in New York. With four stories, including a bedroom, bathroom, and lounge area, the treehouse also boasts an open-air deck on the top floor, perfect for stargazing. Overlooking a dry riverbed, the treehouse provides an excellent location for spotting wildlife, including the famous white lions of the Timbavati. 

The Sky Beds in the Northern Okavango Delta are a wild experience. Perched in the northern region of the Khwai private reserve, the treehouse overlooks a large waterhole frequented by herds of rumbling elephants. The best part? You get there in style! Suppose you’re staying at Tuludi Lodge , Sable Alley or Little Sable . The transfer from the lodge is by helicopter, adding to the sense of excitement. Not only is it thrilling, but it also gives you a breathtaking aerial view of the surrounding area and the animals below. The treehouse boasts three elevated platforms, a cosy double bed, and a communal lounge area. Walkways connect the platforms, with each offering a unique vantage point of the breathtaking landscape, so you’re not entirely on your own. And there’s a guide and chef too. The open-air concept allows you to fully immerse yourself in nature, so you can fall asleep under the stars to the soothing sounds of the wild.

The Kingston Treehouse in Greater Kruger Park is in a remote and hidden place. Located in the Sabi Sands Private Game Reserve, it’s an elevated masterpiece of a treehouse that will leave you breathless. With a cosy bedroom and bathroom, you can relax in style while enjoying the stunning wildlife views. A viewing deck awaits you. From here, you’ll have a front-row seat from which to watch all the creatures of the wild. This place is known as the land of the leopards. You can bet your bottom dollar that you’ll see these magnificent creatures in action. It’s a unique and unforgettable experience guaranteed to leave you longing for more.

Xigera Treehouse in the Okavango Delta is not exactly a treehouse, mind you. It’s more of an elaborate art installation that wouldn’t be out of place at Burning Man. It’s designed to resemble a tree. (a giant ancient baobab) but don’t let that fool you; it’s an architectural sight to behold. You’ll feel like you’re in the lap of luxury, surrounded by water and wilderness. Sometimes you just need a little pampering. And let’s face it, who doesn’t want a bit of glamour in their treetop retreat? So indulge in some solitude, take in the scenery, and watch the wildlife from your elegant, elevated perch. It’s more than a treehouse, it’ll make you wonder, why you don’t live permanently in a baobab – we did.  

If you’re looking for an unconventional hotel experience in Cape Town’s Waterfront, the Silo is the perfect pick. While it’s not a traditional treehouse, it’s built atop an old granary. Bucket List. The friend I traveled with on this adventure has been my friend for 55 years. This was her number 1 item on her bucket list. When I told her I would go.....she started planning. Within 15 or so months......we were off. And I couldn't be happier.

The camps we stayed at were all top notch. The food was great and very abundant (even the breakfast and lunches we ate on the road). I don't eat that well at home. The pancakes at Sametu were the best I have ever eaten.

We couldn't have done this without the help of Lynn's planning expertise. She helped us every step of the way. Giving tips and making sure that we stayed on task. I feel like I have made a friend. She was fantastic. Our safari was specifically planned for us. We decided what we wanted to see and Lynn helped us plan this perfect trip.

When Joseph and Ester came to go over the trip with us in Arusha, I knew it was going to be wonderful. They explained everything that would happen at each camp so there would be no surprised. And Joseph met us at the end and made sure that we had gotten through to the gate at the airport. Unique Safari was with us from the first minute in Arusha to the last. This was very comforting. I am a person who likes to plan ahead and have everything ready. I never had to worry about anything....they did it for me.

Now to talk about our guide FAZAL. Words cannot express what an adventure he gave us. He asked what we wanted each day, and our response was always "You're the expert you tell us". And we are so happy we did. I can tell you that we saw some amazing things. Actually every night, I asked him how he was going to top that tomorrow. My advice to anyone planning a safari would be to trust the people who are the experts. Fazal taught us not to rush through any experience. Sometime you have to wait to see the best part of an animal.

I was very excited to go on this Safari but it was 100% more than I expected, The saddest part of this trip was when we said good bye to Fazal at the airport. There were definitely tears.

This trip was postponed due to, well you know. It was well worth the wait. Unique Safaris was top notch and the Guides, Russell, Shedrack and Fazal were knowledgeable, funny and willing to help us get the best experience and the best photos every day. They even helped me learn firsthand about some of the local flora (don't step on these). Our camps and their staffs were excellent and the people of Tanzania were friendly and helpful. You will not be disappointed using Unique for your safari needs also they are a locally owned company so you will help support their economy and businesses.

Traveling the world in a pandemic can be tricky but Meg K. of Unique Safaris did a wonderful job helping us in our safari travel to Tanzania. She kept us up to date on all of the requirements and gave us links to the forms that were needed. She arranged for our covid test prior to leaving Tanzania. She got us a service that whisked us through covid testing, immigration, and customs at the airport. On Safari, all of the camp staff not only went out of the way to make us comfortable but were very conscientious about all of the covid requirements. The highest praise has to go to our guide, Ellison. He got us into position for many a great photograph and didn’t complain when we asked him to move a foot or two so that we got a cleaner image. He was very knowledgeable about where the animals could be found, so we were treated to baby hippos, lion cub, leopard cubs, cheetah cubs, and a myriad of young antelope and zebra. The Mara River crossings were more spectacular than the Great Migration that we saw when we went to Tanzania March 2020. Photographically it was the best photo tour we had ever been on, totally Unique.

Absolutely the best vacation we have ever taken!!!!!! Lynn is what makes this trip so incredible! Her attention to every detail in planning the experience you want, her communication with you is impeccable! I truly cannot thank her enough! Once we arrived - all the planning Lynn mapped out for us, just played out more amazing then we could of ever imagined. Our guide, Russell was outstanding! He was kind, considerate, and so knowledgeable about every single question we asked him. And we asked a lot of questions!!! He really knew the area, animals, and the culture, etc. All the tented camps, food, transfers, and every detail is taken care of by Lynn. We simply showed up and had the most amazing trip of our lives!!! We are already planning a return very soon, Lynn and Unique Safari will be helping us again!!!

If you are considering going on that "once in a lifetime" trip to Tanzania, do yourself a favor and use Unique Safaris. I travel a LOT and Unique is a company that can be trusted and they will make sure your trip is fabulous. I just returned from a 2 week safari and I can't say enough good things about the drivers and camp staff. There were 11 of us on this trip and everyone had a great experience. The tears and hugs when we left our drivers at the airport to go home said it all.

I wanted to take my daughter on safari as her graduation gift, but also wanted a strong focus on the photographic element as a photographer. Yes, I shopped other safari companies too. Lynn at Unique safaris did an amazing job of putting together a custom trip which included cultural activities, balloon rides, and the best game viewing opportunities ever. I made the right choice and am so grateful I did. The staff in Arusha matched us with a guide based on all the info we had provided. Bernard proved to the best guide we could have asked for. He took his job and professional responsibilities very seriously, and yet was able to join in the fun, banter and laughs. The lodging chosen was superb and the food unbelievable good; both roast duck and lamb on New Year's Eve-and we were hours out in the bush. The attention to detail from Lynn in trip preparation, availability and quick response to questions as well as the follow-through on those promises by the Arusha staff make this unquestionable the safari company of choice.

My wife and I just returned from our safari in the Serengeti with Unique Safaris. Ally, our guide, was fantastic in locating animals and birds during our trip. He was able to drive to locations that other guides would NOT attempt due to it being the wet season and some of the roads (basically dirt tracks through the Serengeti) were covered with water and had terrible holes that you could not see until you hit them. The difference with Unique is they use Mud Terrain tires not All Terrain tires like the other safari companies. Other companies stay on the main roads so you see the animals 100 yards away with 15 vehicles parked on the road while we were able to go to more isolated areas and get up close to the animals. Up close being lunch with a large price of lions and 5 lion brothers s walking by our vehicle and hitting it with their tails. We were able to see everything that we had on our wish list as well as gain a better appreciation for the birds in the Serengeti.

We stayed in tents while we were there so the animals were VERY close. The animals can get noisy at night so be prepared to wake up occasionally. One morning we woke up to the sounds of 8 lions taking down a wildebeest about 50 yards from our tent. Our guide had to pick us up for breakfast that morning in our vehicle since the lions were so close. When you stay in the tents you will need someone from the camp to walk with you when it is dark. Also as a treat Ally arranged for us to meet with a Project Cheetah expert researcher who gave us a much better insight into the amazing animal.

I usually do not write reviews but the difference in companies is significant. If you want to see a few animals with the crowds then Unique is not for you. If you do not mind getting bounced around in the vehicle to get to isolated areas and truly experience the Serengeti then Unique is your best option.

Meg did a good job working with us to get within our budget. I would recommend working with her to get within your budget rather than settling for a less expensive nondescript safari.

This was truly an exceptional once in a lifetime experience and Unique Safaris made all the difference. We also met the owner while on safari, and Ali was engaging and made us feel very welcome.

Paste magazine announced they removed the byline from their review of Taylor Swift’s “The Tortured Poets Department” album due to “threats of violence” following a review of one of her previous albums.

“Editor’s Note: There is no byline on this review due to how, in 2019 when Paste reviewed ‘Lover,’ the writer was sent threats of violence from readers who disagreed with the work,” the publication wrote via X Friday.

“We care more about the safety of our staff than a name attached to an article.”

The magazine’s “TTPD” review — which read “Paste Staff” on the byline instead of the writer’s name — was again critical of Swift, questioning her songwriting abilities on her 11th studio album.

The secret critic also slammed the Grammy winner’s newly released single, “Fortnight,” which features Post Malone.

“Between producer Jack Antonoff’s atrocious backing instrumental and the Y2K-era, teen dramedy echo chamber of a vocal harmony provided by out-of-place guest performer Post Malone, ‘Fortnight’ chokes on the vomit of its own opaqueness,” the review stated.

The critic continued, “I took the miracle move-on drug, the effects were temporary,’ Swift muses, and it sounds like satire. This is your songwriter of the century? Open the schools.”

The review also said the billionaire singer had given her “worst lyricism to date” on her latest project.

The critic then claimed that Swift, 34, “no longer feels challenged to be good,” but recognized that “TTPD” will “not be a net loss” for her.

“She will sell out arenas and get her streams until she elects to quit this business (a phrase decidedly not in her vocabulary, surely),” the review added.

In the comments section of Paste Magazine’s explanation for their byline removal, people debated whether it was the right move on the publication’s part.

“The readers are ought to disagree with the work if all that’s included in the review is digs at taylor’s personal life instead of her music, do better,” one person wrote .

Another Swiftie weighed in , “Where is the music review? This is a gossip article…”

A third then chimed in , “I don’t agree with most of this review, but I do respect your decision to protect your staff. They don’t deserve to be hunted for having an opinion on art.”

Despite Paste Magazine’s review, “TTPD” reportedly made history, becoming the first album to garner more than 300 million Spotify streams in a single day.

On the project, the “Cruel Summer” singer took aim at Kim Kardashian and talked about her past romances with Joe Alwyn and Matty Healy.

Swift, for her part, celebrated by sharing an intimate home video on Friday with her fans.

Fourth time's the charm: House passes controversial spying bill after bitter infighting

WASHINGTON – The fourth time (yes, the fourth) was the charm for House Republicans when the lower chamber of Congress on a bipartisan basis voted to renew a controversial spying law, not without plenty of hiccups along the way.

The House approved reauthorization of the Foreign Intelligence Surveillance Act , or FISA, by a vote of 273-147, on Friday, with most of the bill’s dissenters coming from the body’s civil-liberty minded ultraconservative and progressive factions.

The law’s strongest advocates come from the intelligence committee, who say FISA's warrantless surveillance provisions are essential to protecting national security.

The final product wasn’t enough to completely satisfy most of the conservative hardliners that have long been a thorn in House Speaker Mike Johnson’s side. But they ultimately settled on a change to the program’s regular expiration date to two years from five years. They did that with the hope of enacting significant reforms later down the line should Donald Trump win back the White House in 2024 and be positioned through his administration to shape the contours of the next version of legislation.

Among the major sticking points that created headaches for Johnson and his fellow GOP leaders was a portion of the law called Section 702, which allows U.S. authorities to surveil communications of foreigners outside the United States.

That surveillance is later collected into a database for authorities to search without a warrant. But because those foreigners often contact Americans, domestic data is also swept up in collection as well.

Section 702’s opponents heavily pushed for a warrant requirement, claiming it was necessary for American’s privacy rights. The law’s supporters, though, pointed to other reforms made to FISA to prevent abuses and argued a warrant requirement would neuter the program.

“The constitutional liberties of Americans have to come first, we don’t suspend the constitution for anything,” Rep. Bob Good, R-Va., chair of the House Freedom Caucus, said on the steps of the Capitol on Wednesday, flanked by his like-minded colleagues. “That has to be the premium, protecting American’s constitutional liberties.”

Against conservative opposition, Johnson defended Section 702 at a weekly news conference, saying “it’s a critically important piece of our intelligence and law enforcement.” Before becoming speaker last October, Johnson was also a conservative critic of the law but said that classified briefings on the law have given him a “different perspective.”

House Republicans were trying to lead on FISA renewal for months, but the issue revealed deep divisions within the GOP conference and forced Johnson to pull consideration of FISA from the House two times a few months prior due to infighting. The disagreements prompted Congress to temporarily extend the program until April 19.

The House returned this week expecting to reauthorize FISA earlier but it became apparent that right-wingers were heavily opposed to the legislation, accusing leadership of manipulating the process to sidestep them. 

It certainly didn’t help that Trump essentially gave the hard-right his blessing, posting on Truth Social telling Republicans to “KILL FISA.”

In retaliation against leadership, 19 of those conservative lawmakers shot down a traditionally procedural “rule” vote for the bill on Wednesday, bringing the House to a standstill and highlighting the ugly divides between House Republicans once again.

The new bill Republicans presented isn’t far off from what conservatives tanked earlier this week, with the only major change being the shortened two-year expiration date, but that modification was enough to satiate hardliners to allow the legislation to pass in hopes of Republicans taking full control of Washington in the 2024 elections to drastically change the law later on.

Conservatives were also able to pressure leadership to allow a vote on an amendment from Rep. Andy Biggs, R-Ariz., that would have included a warrant requirement under Section 702, but the amendment failed in a nail-biter vote of 212-212 where the issue divided both sides of the aisle.

The House isn't necessarily done yet though. In a bid to stop the bill from going to the Senate, Rep. Anna Paulina Luna, R-Fla., filed a procedural motion just before lawmakers left Washington for the weekend that if it's adopted would force the House to vote again on the measure.

House Intelligence Committee Chairman Mike Turner, R-Ohio, moved to dismiss Luna's effort, and the chamber is now slated to once again vote on the issue when members return next Monday.

Without the warrant requirement, the bill is expected to easily clear the Democratic-controlled Senate and the White House has expressed support for the renewal of the law as well.

Rep. Dan Newhouse (R-Wash.) is among a dying breed in Congress: Of the 10 House Republicans who voted to impeach Donald Trump after the Jan. 6 , 2021, attack on the Capitol, just Newhouse and one other remain in the chamber.

If Trump has his way, that won’t be the case much longer.

The former president last week endorsed Jerrod Sessler, a conservative Republican who has never held public office but who is once again challenging Newhouse in the race for the 4th District in Washington state.

In a post shared on his social media site Truth Social, Trump said Sessler is “MAGA all the way, and has my Complete and Total Endorsement — He will never let you down!!!”

Newhouse, Trump said, “has to go.”

Speaking to The Washington Post this week, Newhouse declined to comment on Trump’s endorsement of his challenger, suggesting only that he expected that the former president would do that. Newhouse, however, remained optimistic that he will prevail in the primary.

“I’m going to win,” he said. “I’ll work as hard as I can.”

Of the 10 House Republicans who voted with Democrats to impeach Trump after a mob of his supporters broke into the Capitol on Jan. 6, only Newhouse and Rep. David G. Valadao (R-Calif.) remain in the House. Valadao faces a difficult general election in the 22nd District of California — a district that President Biden won by about 13 points in 2020.

Trump has long sought revenge against the Republicans who turned against him in the wake of the Capitol attack.

In 2022, four of the 10 Republicans — then-Reps. Tom Rice (S.C.), Jaime Herrera Beutler (Wash.), Liz Cheney (Wyo.) and Peter Meijer (Mich.) — lost their primary races to challengers from the right.

Four others — then-Reps. Fred Upton (R-Mich.), John Katko (N.Y.), Anthony Gonzalez (Ohio) and Adam Kinzinger (Ill.) — chose to retire. Only Newhouse and Valadao were able to hold on to their seats.

Upton — who did not run for reelection in 2022 after his Michigan district was redrawn in a way that probably would’ve pushed him out in the general — told The Washington Post on Wednesday that he is sure Trump’s decision to endorse Newhouse’s challenger is “more vengeance.”

Upton said that “everyone had their own reason to vote the way that they did” on Trump’s impeachment charges.

“Some were worried for their own safety. Some said, ‘You know, this is what my district would want,’ versus perhaps what I saw firsthand,” he said. “And some were, frankly, just scared of this bully.”

Newhouse’s district, Washington’s 4th, is a solidly red seat. The congressman has easily won reelection there by wide margins since 2014, most recently in 2022, when he defeated his Democratic opponent by 35 points. Trump won the district by 19 points in 2020. These numbers probably make the primary election the de facto general.

In his endorsement of Sessler, Trump called Newhouse a “weak and pathetic RINO” — short for “Republican in name only.”

This is not the first time Sessler, a Navy veteran and businessman, has challenged Newhouse. In 2022, Sessler and five other Republicans tried to unseat Newhouse, a farmer, but Newhouse prevailed. This time, however, Sessler is the only candidate challenging Newhouse in the GOP primary.

In a post shared on X after Trump’s endorsement, Sessler said, “#Honored.” Online, Sessler often shares messages from some of the most right-wing members of Congress and touts his credentials as a political firebrand.

In an interview with The Post last month, Newhouse said that while many of his moderate Republican colleagues in the House are leaving Congress — citing their conference’s inability to collaborate and strike successful legislative deals — he still has unfinished business in the chamber and will not let himself be discouraged from being in office by the extreme wing of his party.

“I’ve still got some things I want to accomplish, some issues that are important to me. It is a difficult environment, but it’s always hard, it’s never easy to get legislation through,” he said. “One of my biggest priorities is making some positive changes to our agricultural labor laws, and we’ve been getting we’ve been making progress. I don’t want to leave before that’s done.”

Upton said he is optimistic about his former colleague’s chances and said he believes Newhouse is the type of lawmaker who should remain in Congress.

“He’s got an unblemished record. He’s honest as the day is long. He’s the type of people that voters ought to want in a responsible position like a member of Congress,” Upton said. “He’ll be able to sell that back home. But it’s likely going to be a rough couple of months. And it raises questions on the personal side: Is it worth it?”

Justices to hear case on near-complete ban amid shifting legal landscape after overturn of Roe

Since the Supreme Court overturned Roe v. Wade in June 2022, 21 states have enacted laws that strictly limit abortion.

Next week, justices will hear arguments over the first and among the most restrictive of those new laws. Idaho’s statute calls for a near-complete ban on abortion and prohibits anyone from performing or assisting one except when the pregnancy is ectopic or molar; a result of rape or incest; or a risk to the life of the mother.

The U.S. Department of Justice argues those restrictions conflict with a 1986 federal law requiring hospitals that participate in Medicare to provide stabilizing treatment to emergency room patients regardless of their ability to pay. Both the federal District Court and U.S. Court of Appeals in Idaho sided with the federal government and had blocked the state ban from going into effect. The Supreme Court lifted the injunction in January when it agreed to hear the case.

Several other abortion cases are moving through federal and state courts. Notably, Arizona’s top court upheld a Civil War-era law last week criminalizing abortion in all circumstances except to save a pregnant woman’s life.

The Gazette spoke with I. Glenn Cohen , James A. Attwood and Leslie Williams Professor of Law at  Harvard Law School  and faculty director of the Petrie-Flom Center  for Health Law Policy, Biotechnology, and Bioethics at HLS, about the legal landscape after the Dobbs v. Jackson Women’s Health Organization ruling that overturned Roe and what a decision for Idaho might mean for other states. The interview has been edited for clarity and length.

There has been a flurry of abortion-related legal challenges since the overturning of Roe. Can you describe some recent developments?

On April 1, the Florida Supreme Court upheld the state’s 15-week ban, which, because of the way the law is written, means the state’s six-week ban will go into effect in 30 days. The Court also allowed a ballot initiative to go forward, so Florida voters will get to vote on abortion.

Last week, the Arizona State Supreme Court cleared an 1864 abortion law in the state to go into effect — a law that predates Arizona’s statehood that prohibits abortion without exceptions for rape or incest. An attempt by Democrats in Arizona’s legislature to repeal that 1864 law failed.

The state’s attorney general, Kris Mayes, and some county attorneys have said they will not prosecute abortion cases under the law, but it is not clear whether providers will be willing to perform abortions even with those assurances.

Moreover, such assurances can change with changes in who is in charge. There is a proposed ballot initiative in Arizona that would enshrine some abortion rights protections in Arizona’s state constitution, so, as in Florida, voters will be able to have their say.

“When does federal law pre-empt state law? There are multiple types of pre-emption arguably raised in this case. The key question is whether any of those apply.”

In terms of what’s before the Supreme Court or making its way to the Supreme Court, I’d say there are three main cases to keep an eye on.

One is the mifepristone litigation, where oral argument happened on March 26, which is about whether FDA appropriately altered the drug’s Risk Evaluation and Mitigation Strategies in 2016 and 2021. REMS are potential restrictions on the use of that drug that has been approved. That case is really about medical abortion.

We’ve got this case in Idaho, which is about states, in the wake of Dobbs, that have more narrowly limited their abortion laws such that there are now questions about emergencies and questions about exceptions for life and health of the pregnant person. This case presents that question squarely.

And then, floating in the background, but not yet squarely before the U.S. Supreme Court, is the Comstock Act. The question the Court may eventually have to answer is whether this very old act, more than 100 years old, restricts sending in the mail drugs used for abortion or even tools that could be used for surgical abortion.

We are seeing all these cases now in part because while these questions were always in theory there, there was a constitutional protection of abortion that restricted states from going below a certain minimum, such that very few such restrictive measures were active and had legal questions that needed to be resolved.

But now, in the wake of Dobbs, we’ve got states that have more or less completely limited abortion except under very narrow circumstances. What’s so interesting about the Idaho case is that the Emergency Medical Treatment and Active Labor Act is a general law about emergency treatment and stabilization. And so, we’re talking about how it intersects with what Idaho and other states may have done.

What’s the legal question at issue in this Idaho case?

Part of what makes the case complicated is the parties have slightly different views about what the state of play is. The federal government puts the question presented as “whether EMTALA pre-empts Idaho law in the narrow but important circumstance where terminating a pregnancy is required to stabilize an emergency medical condition that would otherwise threaten serious harm to pregnant women’s health, but the state prohibits an emergency room physician from providing that care.”

Idaho frames it as “whether EMTALA pre-empts state abortion regulations and requires hospitals to perform abortions disallowed by state law.”

One of the pieces of wrangling that has occurred throughout litigation is exactly what is prohibited by the Idaho Defense of Life Act. Questions about pregnancy termination related to ectopic pregnancies, pre-eclampsia, and stuff like that. So, the parties, I don’t think, are in complete agreement over the question about what the act prohibits or doesn’t prohibit.

What is there for the Supreme Court to consider? Doesn’t the Constitution already say that when federal law conflicts with state law, federal law prevails?

Exactly right. Under the Supremacy Clause of the Constitution, federal law trumps state law where they conflict. But what it means for the laws to conflict is a nuanced question. So, the question is: When does federal law pre-empt state law? There are multiple types of pre-emption arguably raised in this case — express, implied, and obstacle. The key question is whether any of those apply, which, in turn, depends on understanding what EMTALA requires.

On Idaho’s side of the case, their argument is there isn’t a conflict with EMTALA because EMTALA doesn’t reach this particular question. And on the other side, the federal government argues it definitely does apply here. So, part of this is an interpretation of what EMTALA does and does not require.

Has EMTALA been challenged before in other contexts?

There have been some EMTALA cases. There’s a famous case called the Baby K case from many years ago. Baby K was a Fourth Circuit case from 1994 about a baby born with anencephaly — missing a major part of the brain that is necessary for conscious thought — and whether a hospital could decline to provide a ventilator to the newborn if the newborn came to the ER.

There was a Fifth Circuit case from 1991, Burditt v. U.S. Department of Health and Human Services, unsuccessfully challenging EMTALA as unconstitutional. In the Supreme Court certainly, EMTALA cases been relatively few and far between.

The justices referenced EMTALA quite a bit during oral arguments in the recent mifepristone case, FDA v. Alliance for Hippocratic Medicine. Why do you think that is?

There was a lot of shadowboxing around the Idaho case in the mifepristone oral argument .

In particular, two things to highlight: One is this question about so-called “conscience clauses” and whether EMTALA could ever overcome legal protections for conscience and thus, require a physician to perform an abortion against her or his conscience.

Solicitor General Elizabeth Prelogar gave, I think, the correct answer, which is that EMTALA obligations sit on a hospital, not on a physician. And typically, hospitals have systems in place that if they have a physician who is conscientiously objecting to abortion and protections for that under law, it’s up to the hospital to find a substitute, which is, I think, a correct statement of the law, but one I’m sure there’s going to be some pushback on.

Second, there was some sniping at the mifepristone argument about whether the government has changed its position on the conscience question and whether they’ve changed their position and given different answers to this question at different stages of the litigation.

On the flip side, in the Idaho case, the federal government argues the state of Idaho keeps changing their position about what their theory of pre-emption is. So, I think there’ll be some nasty questioning — “has this always been your position, has your position changed” and the like. I don’t think it’ll actually make a difference to the outcome, but that’s something that I expect that we’ll hear at argument.

A Supreme Court decision in Idaho’s favor could impact people in many other states. How might that unfold?

I wouldn’t say every state because many states have robust protections. In those states there may be some fairly robust protections regarding emergency exceptions for the health and life of the mother.

In a state like Massachusetts, we’re not going to get the conflict we saw in this case. Elsewhere it looks different. There was a parallel EMTALA case in Texas, and Texas won that one. So currently, the court in Texas has allowed Texas’s law to go into effect.

The Solicitor General, in her brief in the Idaho case, had a footnote listing the states they think this is going to be most relevant to. Texas is certainly one of them. Footnote 11 in the Solicitor General’s briefs says seven states, including Idaho, have laws that lack a health exception. They name Arizona, Arkansas, Mississippi, Oklahoma, South Dakota, and Wisconsin. But it says several of those laws are in flux. So at least in those seven states directly relevant.

But there are some other states that have restrictions on health exceptions for abortion that are not as firm as the ones in Idaho but are narrower than what the federal government understands to be required by EMTALA, where this decision will also be relevant. Moreover, there may be some states that might see a win for Idaho in this case and learn and rewrite their statute to be narrower than it is now.

Does the federal government have any recourse if Idaho prevails? Could the government withhold Medicare reimbursements to those states, for example?

I think the answer is probably no, in part because the Supreme Court is giving the definitive reading about what EMTALA means.

If the government, under EMTALA, threatened to remove Medicare and Medicaid funding from the hospitals in a state that allegedly violated EMTALA, they would now say, “We’re not violating EMTALA. See the decision in this case.”

What would have to happen would be congressional action to change the language if Idaho wins. In such legislation, Congress could just say EMTALA requires that the health of the mother be considered in a particular way as a requirement of the statute.

Congress could also pass a freestanding statute that said the same thing. This sometimes happens — the Supreme Court gives an interpretation of a statute; Congress doesn’t like the interpretation; and Congress changes the statute.

In theory, that could happen here. In reality, the politics would require Democrats to have a majority in both houses and unless the filibuster is going to go away, would require a filibuster-proof majority in the Senate, and that’s quite unlikely.

The other thing that’s possible is, and this is going to be even more unlikely, is forget EMTALA. If there’s federal protection provided to abortion in general [through legislation], some federal backstop that says, “States have power to do some things, but not this. This is too far,” then the federal government could also include more protections for health and life of the mother exceptions.

One more thing that’s in play here: the interpretation of what does Idaho state law mean or what does Texas state law mean in terms of the breadth of the exceptions is typically not for the U.S. Supreme Court to decide because they’ve said when a decision rests on an independent adequate state ground, the Supreme Court will not review the case.

But there is a question under state law, what does the exception mean. Texas right now is having litigation in the Texas state courts about what its emergency exception for abortion covers. So, another possibility is the people of Idaho change their law, or the Idaho Supreme Court interprets the law in a way that is more friendly to abortion access. Those are also possibilities. Though as the failure of legislation to protect abortion in Arizona I mentioned before shows, in many states changing abortion law via ordinary legislation will be an uphill battle.
