West Midlands tourist town popular with Brummies has got ‘worse pothole than Birmingham’

One of the most popular destinations visited by Brummies has been blighted by a giant pothole - worse than some in Birmingham

A Tempest is brewing in Shakespeare's hometown with locals claiming to have the 'UK's oldest pothole'.

The 24-year-old crater is just yards away from Holy Trinity Church in Stratford-upon-Avon, where the Bard was baptised and later buried. The pothole was first spotted in 2000 after an infected tree was felled and the roots dug out.

Despite repeated appeals to have the hole repaired, it has remained unfilled and is now a whopping 9ft long. Locals have branded the hole "ridiculous" and say it is becoming a landmark in its own right.

Get a bespoke headline round-up, as well as breaking updates, when you sign up to BirminghamWorld’s free emails David Neale, who is clerk of works for Holy Trinity Church, said: “It is spectacular. No fish have been found in its depths but it’s accommodated plenty of ducks. In winter it acts as a soakaway, and is permanently submerged with water, in summer it is a big dry pothole attracting rubbish because the road sweeper can’t reach into it.

“Back in the mists of time I spoke to a councillor about it, and the council must know it’s here. I’ve recently brought it up again, so hopefully something might be done - it’s a trip hazard.  Otherwise I’m going to get gnomes with fishing rods and turn it into an attraction.”

Retired builder David added: “I was amazed to read that the council had paid out £78,000 for pothole damage when to repair potholes isn’t costly - even to repair this one would be less than a day’s work. The cost of tarmac is negligible if you’re going to do a lot of them, ten ton of tarmac is only about £500.

Motorists have also expressed frustration that the pothole has not been fixed. Andrew Howell, 50, said: “It’s a bit of a town joke having the country’s oldest pothole but there is a serious safety issue here. I’ve seen cars swerve to avoid it and come close to hitting other vehicles. In the winter it’s more like a pond while in the summer it’s a dust bowl. It’s ridiculous that no one has filled it in yet considering it’s been there for almost a quarter-of-a-century."

A spokesperson for Warwickshire County Council said: "Warwickshire County Council Highways is aware of an area in Trinity Close, Old Town, Stratford-Upon-Avon that is prone to settlement following the removal of a large tree sometime after 2019. As the remaining wood and root system decays underneath the carriageway, this settlement can lead to deterioration in the carriageway surface, so WCC County Highways continues to monitor the situation and carry out repairs as necessary."

The West Midlands police and crime commissioner (PCC) has won a High Court challenge against government plans to merge the role with the region's mayor.

Labour PCC Simon Foster took legal action against the Home Office's move to end his role in time for local elections in May.

His powers over West Midlands Police had been set to be merged with those of mayor, a role currently held by Conservative Andy Street.

Ruling in favour of Mr Foster, the judge Mr Justice Swift said the Home Office had not provided sufficient information when consulting over its plans.

The government department said it was disappointed by the outcome and intended to seek permission to appeal.

'Cynical power grab'

Mr Foster had branded the plan as a "hostile takeover" and "cynical power grab".

After the ruling was made, he said he was "concerned that the transfer of PCC powers to a representative of the government would lead to more cuts, more chaos and more crime".

Announcing it would look to appeal the outcome of the High Court challenge, the Home Office said it firmly believed joining up public safety functions under a combined authority mayor offered a "better scope for preventing crime".

It said the success of the model was "already evident" in Greater Manchester, West Yorkshire and London where the mayors already had responsibility for policing and crime.

The West Midlands mayor said he was "incredibly disappointed" with the High Court's decision.

Mr Street added he had always believed the best way to tackle crime was to merge the roles "so we could work in absolute unison to address all of the issues that we face".

After being asked who the Conservatives would have on the PCC ballot, Mr Street said "the party, not me, will now decide what it wishes to do".

BBC political reporter for Birmingham Simon Gilbert said this had been a victory for Mr Foster, "but for how long?".

In his 23-page written ruling, the judge said: "The home secretary did not, when consulting, provide sufficient information to permit an intelligent and informed response."

Mr Justice Swift said there should have been information to support the government's move, including over the proposed impact on "economic, social and environmental well-being", but what featured on this occasion, "falls well short of this mark".

The judge added a claim the consolidation of powers has the potential to offer "a more joined-up approach to preventing crime was left entirely unexplained".

Elected PCCs set local police budgets, decide what crimes it should prioritise with investigations, can appoint and sack the chief constable and also be accountable to communities.

Every force area in England and Wales is represented by a PCC apart from London, Manchester and West Yorkshire, where the mayor holds the responsibility instead.

In May, PCC functions are also due to transfer to the South Yorkshire mayor.

'Potential plot twist'

At a hearing this month, Mr Foster's lawyers argued the Home Office's consultation was "no more than a tick box exercise", with Home Secretary James Cleverly having a "closed mind" on the issue.

The Home Office told the court in London the transfer decision was taken "with an open mind, following a lawful consultation and with regard to relevant information".

Mr Gilbert said: "Today's judgment makes clear the High Court does not believe the correct process was followed to merge the police and mayor roles. What it doesn’t say is that the roles can never be merged."

The BBC political reporter said there would be an election for a West Midlands PCC on 2 May and "here's a potential plot twist" - there is nothing to prevent Mr Street from standing for his party in that election too.

"But, even if the PCC election goes ahead, how long will whoever wins be in post?," he asked.

Highlighting the mergers that have already taken place, the "direction of travel appears to be clear".

"Today’s ruling might just mean the journey takes a little longer," he added.

Home Office had planned to scrap the police commissioner role held by Labour’s Simon Foster and give powers to mayor

The police and crime commissioner for the West Midlands has won a high court challenge against government plans to transfer his powers to the region’s mayor.

Simon Foster, a Labour politician, took legal action against the Home Office’s move to scrap his role in time for local elections in May.

His powers over the local police force are to be merged with those of the West Midlands mayor – a role currently held by a Conservative, Andy Street.

On Monday, a judge ruled in Foster’s favour, concluding that the Home Office had not provided sufficient information when consulting over its plans.

Foster said the ruling meant an election for his PCC role would take place on 2 May.

Foster had called the plans a “hostile takeover” and “cynical power grab” and said there were failings in a public consultation.

At a hearing earlier this month, his lawyers argued the Home Office’s consultation was “no more than a tick-box exercise”, with the home secretary, James Cleverly, having a “closed mind” on the issue.

The Home Office told the court in London that the transfer decision was taken “with an open mind following a lawful consultation and with regard to relevant information”.

In his 23-page written ruling, Mr Justice Swift said: “The home secretary did not, when consulting, provide sufficient information to permit an intelligent and informed response.”

Foster said he was “concerned that the transfer of PCC powers to a representative of the government would lead to more cuts, more chaos and more crime”.

He claimed the mayor and home secretary had “wasted everyone’s time and taxpayers’ money”, and caused “incalculable distraction and disruption” for West Midlands police and local officials, and uncertainty for the public.

He added: “I am pleased that the mayor’s cynical, divisive, unnecessary and undemocratic attempted hostile takeover of PCC powers has been defeated. I trust that we can now all concentrate on what matters most to the people of the West Midlands, which is ensuring that we all work together in partnership to prevent, tackle and reduce crime.”

The judge said information should have been provided to support the government’s move, including over the proposed impact on “economic, social and environmental wellbeing”, but what featured “on this occasion falls well short of this mark”.

Swift said a claim that the consolidation of powers has “the potential to offer wider levers and a more joined-up approach to preventing crime” was “left entirely unexplained”, and observed that the process of finding documents referred to but not provided in the consultation “ought not to become a treasure hunt” for consultees.

Elected PCCs set their local police force’s budget, decide what crimes it should prioritise, can fire and hire the chief constable and aim to make sure they are accountable to the communities they serve.

Every force area in England and Wales is represented by a PCC except London, Manchester and West Yorkshire, where the mayor holds the responsibility instead. PCC functions are also due to transfer to the South Yorkshire mayor in May.

Street wrote to the home secretary in November requesting the powers transfer – an option that became available under the Levelling Up and Regeneration Act passed last year.

Later that month, Cleverly decided to proceed with transferring the PCC’s powers for the May 2024 election.

But after a legal letter from Foster, who was elected to his role in May 2021, officials realised an “error” in the drafting of the law meant it required a consultation.

This prompted a six-week consultation between December and January, after which Cleverly again decided to back the transfer, which must be approved by parliament.

In his judgment, Swift said: “I am satisfied that the responses to the consultation were conscientiously considered.”

However, he said he was not satisfied that evidence in the case “should be read as suggesting that the consultation undertaken was not in aid of a genuine re-taking of the decision” and that he did not consider that “it warrants either the conclusion that the home secretary undertook the consultation with a closed mind or the conclusion that there was a real possibility that he did”.

Street said: “[I am] very disappointed in today’s ruling, as I firmly believe that a change in governance is required to help tackle the rates of crime across the West Midlands.

“With crime having doubled and West Midlands police in special measures, I was not prepared to stand by any more and so followed the process as set out by the Home Office to merge the PCC role with the mayoral role at May’s elections.

“I have always believed that a merged role – as is the case in Manchester, London and West Yorkshire – is best for the West Midlands.”

A government spokesperson said: “We are disappointed by this outcome and intend to seek permission to appeal.

“We firmly believe the join-up of public safety functions under a combined authority mayor offers a better scope for preventing crime. The success of the model is already evident in Greater Manchester, West Yorkshire and London where the mayors are already responsible for policing and crime.”

Replace a lost or stolen ticket or pass.

We can replace paper travel passes and season tickets. We cannot replace single or return tickets.

There are different rules if you need to replace a lost or stolen Swift card . This includes the 16-18 photocard.

Replace a pass bought on our website or through the corporate travel scheme

To replace your pass, call us on 0345 303 6760. There’s a fee of £7.50, so have a debit or credit card ready.

Your new ticket will be sent in the post. Allow up to 5 working days for it to arrive.

If you paid by Direct Debit, you can also replace your pass online .

Replace a paper nNetwork season ticket bought at a station

We can only replace paper nNetwork season tickets.

We can replace season tickets that are valid for 13 weeks or more. To replace your ticket, call us on 0345 303 6760. You’ll need to send us proof of purchase and pay a fee of £7.50.

We cannot replace rail-only season tickets. If you’ve lost a rail-only season ticket, visit the station you bought it from.

Replace a school or student term ticket

To replace a term ticket, call us on 0345 303 6760. Have a debit or credit card when you call - there’s a fee of:

  • £7.50 for school & student tickets

When we’ve taken your payment, we’ll also ask you to email us one of the following:

  • the tear-off from the original ticket
  • your receipt
  • a letter from your school confirming you’ve been issued with a ticket and how long it was valid for
  • a new photo

Replace a free travel (concessionary) pass

You can use this service if you’ve lost your:

  • older person’s travel pass
  • disabled person’s travel pass

If you’ve lost your pass, you can:

  • order a replacement online
  • download, print out and fill in the replacement pass form and send it to the address on the form

Replacement passes cost £7.50. You should get your pass within 5 working days.

If your free travel pass has been stolen

If your pass has been stolen, report it to the police. They’ll give you a crime reference number.

When you have the crime reference number, you can get a replacement pass free of charge. Contact Customer Services to arrange this.

UK motorists have been urged to to think about their actions over motorway closures. Video footage shows near misses with National Highways traffic officers as workers speak out over motorists brazenly flouting their restrictions.

National Highways traffic officer Michel Reitsma said: “We don’t stop traffic for the sake of it, we are trying to keep the area safe. You are trying to do your job, trying to help people and protect them and there are some with a mindset to be abusive or behave recklessly. It is just not necessary.”

He explained: “I don’t want to stop traffic, I want to get it moving as soon as possible. But I want to get traffic going safely, safety is paramount.” He went on: “They think ‘it is only a traffic officer’ and that they can do anything they like."

National Highways monitored the M6 route in the West Midlands and found that drivers who were carelessly driving, narrowly missed colliding with road workers. He added: “Only when they are fined do some people realise it is illegal and also that it is not acceptable to be abusive to traffic officers who are just doing their job.”

National Highways director of Health, Safety and Wellbeing, Mel Clarke, said: “Nobody should have to go to work knowing they may be at risk because of the reckless, thoughtless and dangerous actions of some people. Whilst most drivers respect the efforts of road workers who are out there day and night to enhance, maintain and keep our roads safe and running - there are a minority that choose to disrespect these key workers.

“The safety and wellbeing of our own workforce and our supply chain workers is an absolute priority. Anyone who puts that safety at risk either intentionally or carelessly should be aware that it will not be tolerated and we will work with police to take action against those who do so.”
